Amazon has granted a temporary reprieve to employees stranded in India due to prolonged visa processing delays, permitting them to work remotely until early March. This marks a departure from the company’s typically rigid five-day mandatory office attendance policy. The exception applies to staff who were located in India as of December 13 and remain awaiting rescheduled visa appointments.
What Triggered the Visa Crisis
The underlying cause stems from new H-1B visa program policies implemented by the Trump administration, which introduced mandatory social media reviews conducted by consular officers. These additional screening measures have created significant bottlenecks, with some visa appointments shifted to dates years into the future. Amazon, as one of North America’s largest H-1B visa users, filed approximately 14,800 certified H-1B applications during the 2024 fiscal year—a volume that amplifies the impact of these processing delays.
The Fine Print: What Remote Workers Cannot Do
While the accommodation appears generous on the surface, internal communications reveal substantial operational constraints. Employees working remotely from India face a comprehensive list of prohibited activities: they cannot engage in code writing or testing, perform troubleshooting, make strategic decisions, communicate with customers, or participate in contract negotiations or signing. Additionally, they are barred from accessing Amazon facilities within India.
More significantly, all reviews, approvals, and final decisions must be executed exclusively outside Indian territory, with no exceptions permitted under local legal frameworks.

The restrictions pose particular challenges for Amazon’s engineering and technical workforce, given that coding and deployment functionality comprise a substantial portion of their daily responsibilities.
