DeFi Lobbying Group Withdraws Lawsuit Against US SEC Over Airdrop Complaint, Citing Changed Industry Environment

Odaily Planet Daily reports that Texas-based clothing company Beba and the crypto lobbying organization DeFi Education Fund have voluntarily withdrawn their airdrop-related lawsuit against the U.S. SEC in 2024. The lawsuit previously accused the SEC of regulating digital asset airdrops through enforcement actions without formal rulemaking, allegedly violating the Administrative Procedure Act.

The withdrawal document states that the progress of the SEC crypto task force and multiple public statements by Commissioner Hester Peirce suggest that regulators’ attitude towards airdrops may be shifting, including considerations of establishing an airdrop exemption framework and a “safe harbor” mechanism. DeFi Education Fund said that continuing the lawsuit is unnecessary under the current circumstances.
